Article 2: Definitions
In these terms and conditions, the following terms have the meaning set out below:
- "Platform" refers to the website and mobile application accessible at https://teach-me-up.com
- "Participant" refers to any individual registered on the Platform to attend training courses
- "Facilitator" refers to any professional authorized to create and deliver training courses on the Platform
- "Services" refers to all services offered by the Platform
- "Content" refers to all elements (courses, quizzes, etc.) made available on the Platform
- "Quiz" refers to an interactive questionnaire composed of multiple-choice questions, which can be played solo or in a group session
- "Group Session" refers to a real-time quiz session, led by a Facilitator, in which multiple Participants take part simultaneously
- "Group" refers to a grouping of Participants created by a Facilitator to organize and track training
- "Review" or "Feedback" refers to the evaluation left by a Participant at the end of a quiz, including a rating and an optional comment
- "Certification Exam" refers to a quiz in exam mode with a defined passing threshold, resulting in the issuance of a certificate
Article 3: Purpose
These terms and conditions define the terms and conditions of use of the services offered on the Platform. They constitute the agreement between the Platform and the User.
Article 4: Registration and User Account
4.1 Account Creation
Registration on the Platform requires the creation of a user account. The user must provide accurate and complete information.
4.2 Information Updates
The user agrees to keep their information up to date and to inform the Platform of any changes.
4.3 Account Security
Sign-in credentials are strictly personal and confidential. The user is solely responsible for their use and protection.
Article 5: Personal Data Protection
5.1 Types of Data Collected
As part of our service, we collect and process the following data:
- Identification data: last name, first name
- Contact details: email address
- Payment data: bank details (only processed securely during transactions)
- Training data: quiz results, exams, progress, and certificates obtained
- Feedback data: ratings given to quizzes, comments, anonymity preferences
- Group data: membership in learner groups, participation statistics
- Session data: participation in real-time group sessions, scores achieved
- Usage data: connection logs, IP address, browsing data on the platform
5.2 Purposes of Processing
Your personal data is collected and processed for the following purposes:
- Management of your user account and authentication
- Provision of training services and educational monitoring
- Sending results and issuing certificates
- Collection and display of educational reviews to facilitators (identified by default, anonymous at the participant's choice for solo quizzes)
- Communications about platform updates (only with your explicit consent)
- Billing and payment management
- Security and fraud prevention
- Compliance with our legal and regulatory obligations
5.3 Legal Basis for Processing
The processing of your personal data is based on the following legal grounds:
- Performance of the contract for the provision of our training services
- Compliance with our legal obligations (particularly regarding data retention)
- Your consent for the sending of marketing communications
- Our legitimate interest in the security of the platform and fraud prevention
5.4 Data Retention Period
We retain your personal data for the following periods:
- Account data: until account deletion or 3 years after your last activity
- Training data: 5 years after the last training activity
- Billing data: 10 years (legal obligation)
- Connection logs: 1 year
5.5 Data Recipients
Your personal data is accessible to:
- Our authorized personnel, within the scope of their duties
- Our technical subcontractors and service providers
- The Facilitator responsible for the quiz: Participant reviews and comments are visible with the author's name, unless the Participant has chosen anonymity
- Competent authorities upon judicial request
All our subcontractors are subject to strict confidentiality and security obligations
5.6 Your Rights
In accordance with the GDPR, you have the following rights regarding your personal data:
- Right of access to your data
- Right to rectification of inaccurate data
- Right to erasure ('right to be forgotten')
- Right to data portability
- Right to object to processing
- Right to restriction of processing
To exercise these rights or for any questions regarding the processing of your data, contact our Data Protection Officer:
5.7 Data Security
We implement appropriate technical and organizational measures to ensure the security of your personal data, including:
- Encryption of sensitive data
- Strict access control
- Regular data backups
- Regular security audits
5.8 Transfers Outside the EU
Your data is hosted and processed within the European Union. In the event of a transfer outside the EU, we ensure that the destination country provides an adequate level of protection or that appropriate safeguards are in place.
Article 6: Paid Services and Billing
6.1 Pricing and Payments
The prices of our services are displayed in euros and include all taxes (including VAT). We reserve the right to modify our prices at any time. Any price change will be notified to users at least 30 days before it takes effect and will not apply to services already paid for.
6.2 Payment Methods
Payment is made online by credit card through a secure interface. Bank details are never transmitted in plain text and are never stored on our servers.
6.3 Invoicing and Receipts
An invoice is automatically generated and made available in your personal account after each payment.
6.4 Late and Failed Payments
In the event of a failed or late payment, we reserve the right to suspend access to services until the situation is resolved.
6.5 Service Duration and Renewal
The duration of services is clearly indicated at the time of purchase. For subscription-based services:
- Renewal may be automatic or manual, depending on the option chosen
- The user is notified by email before each automatic renewal
- Cancellation is possible at any time from the personal account
6.6 Refund Policy
In accordance with applicable law, you have a 14-day withdrawal period from the date of purchase, except for services fully performed before the end of the withdrawal period and whose performance began with the prior express consent of the consumer.
Refund conditions:
- Written request within the legal deadline
- Services not used or started
- Refund processed within 14 days
Article 7: Intellectual Property
7.1 Platform Rights
The Platform and all its content are protected by copyright and other intellectual property rights. Any unauthorized reproduction is prohibited.
7.2 Facilitator Rights
Facilitators retain their rights over the content they create, while granting the Platform a non-exclusive license to use it.
Article 8: User Obligations
8.1 Participant Obligations
- Comply with these terms and conditions
- Not share their login credentials
- Not copy or distribute training content or certification quizzes and exams
- Write constructive and respectful reviews in feedback
8.2 Facilitator Obligations
- Provide original, high-quality content
- Respect the rights of third parties
- Keep their content up to date
Article 9: Limitation of Liability
The Platform shall not be held liable for indirect damages resulting from its use. The Platform's liability is limited to the amount of services paid for by the user.
Article 10: Termination
10.1 Termination by the User
The user may terminate their account at any time from their personal account. Termination results in account deletion after a 30-day period.
10.2 Termination by the Platform
The Platform may suspend or delete an account in the event of a breach of these terms, after notifying the user.
Article 11: Modifications to the Terms
Users will be notified of any changes to these terms 30 days before they take effect. Continued use of the Platform after such notification constitutes acceptance of the new terms.
Article 12: Governing Law and Jurisdiction
These terms and conditions are governed by French law. The language of the agreement is French. In the event of a translation, only the French version shall prevail.
- Any dispute relating to the interpretation or performance of these terms and conditions shall fall under the exclusive jurisdiction of the French courts
- In the event of a dispute with a professional user, only the courts of Bordeaux shall have jurisdiction
- For individual users, the applicable rules of jurisdiction shall apply
If any provision of these terms and conditions is declared null or unenforceable under any law, regulation, or final court decision, it shall be deemed unwritten and the remaining provisions shall remain in full force and effect
Article 13: Mediation and Dispute Resolution
In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, our company offers a consumer mediation mechanism. The designated mediation entity is: Médiateur en cours de contractualisation. La plateforme est encore expérimentale et non payante. Toute demande de retrait sera raitée sur simple demande en une semaine maximum (en période de vacance) sous 48h autrement.
Mediation steps:
- In the event of a dispute, the user must first contact us in writing to attempt to resolve the matter amicably
- If no solution is found within 30 days, the user may refer the matter to the mediator free of charge
- The mediator will attempt, with full independence and impartiality, to bring the parties together with a view to reaching an amicable solution
- The parties remain free to accept or reject the mediator's proposal
For cross-border disputes, the European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/
Recourse to mediation does not preclude the possibility of legal proceedings
Article 14: Participant Reviews and Feedback
14.1 Collection of Reviews
At the end of a quiz or group session, Participants may leave a review consisting of a rating from 1 to 5 and an optional comment. These reviews are intended to support the pedagogical improvement of content offered by Facilitators.
14.2 Identified Nature of Reviews
Reviews are identified by default: the Participant's name is visible to the Facilitator responsible for the quiz. For solo quizzes, the Participant may choose to publish their review anonymously via a dedicated option ("Publish anonymously" checkbox). Reviews left during group sessions are always identified.
14.3 Data Retention
Even when anonymity is chosen, the Participant's identity is retained in the database for deduplication purposes (one review per Participant per quiz). The Facilitator cannot under any circumstances access the identity of the author of an anonymously published review.
14.4 Pre-existing Reviews
Reviews collected before these terms came into effect remain anonymous, in accordance with the rules in force at the time of their publication.
